
We know that an independent judiciary annoys Power, because it is able to judge when it committs crimes and cheating. Indeed, the judiciary has for centuries been subject to political power, that used it at will. The Italian judiciary in particular was until 1945 not independent, and even after was an independent power only on paper and only in some cases.
Despite all this, the Plan of Democratic Rebirth of the P2, a subversive organization which included the current Prime Minister Silvio Berlusconi, provided for changes in the judiciary, with the rather obvious purpose of subjecting the judiciary to political power. Achieving such a goal will means bring back Italy to 1800, when was realized that only the separation of powers between executive, legislative and judiciary could ensure democracy. To this must be added, as was well understood during the twentieth century, that the so-called fourth power, the press, must be independent of the other three. In Italy, however at present the legislative power of parliament is completely flattened in the execution of measures of the Government, the outcome of an election law that does not allow the preferences and of a majority based on the cult of personality in North Korea style. The press and TV as we know are for most part firmly in the hands of the head of the government, so that everything he does is silenced or presented in a positive light, even when there is nothing positive. The only power to guarantee democracy that remains in Italy now is the judiciary. Once eliminated the independence of the judiciary the P2 Plan will be complete and the Italian democracy will be officially dead.
Alfano, the Minister who has already maimed democracy with his Lodo, a law which makes the 4 highest offices of the state immune to trials, and therefore citizens more equal than others, and intends to shoot it again with the decree on wiretapping, which introduces serious obstacles to the work of prosecutors, a nice gag for the press and blogs and the disappearance of the judges, now is preparing to give the coup de grace to democracy with the reform of the criminal process, a system designed to eliminate the independence of the prosecutor and thus to avoid he could investigate the powerful and the politicians. The reform proposal has been rejected twice by the Superior Council of Magistracy, which anyway has only advisory powers. The majority has the numbers to approve the reform as it wants. The President of the Republic may dismiss it, but should the law pass again he would have to approve it. So the only real barrier is the fact that such a law should be blocked by the Constitutional Court, since it violates the whole block in the title IV of the Constitution, Articles 101 to 113, precisely the ones that speak of the judiciary. And then there is the possibility that Italian citizens rebel before being deprived of all democracy. But to see the Italy of today, the word citizens, coined during the French Revolution, seems excessive. We should talk about subjects or maybe its modern synonym. Tv viewers.
