But sometimes children get "punished". So five italian students were reported for defamation via the Internet, because they had opened on Facebook a group against a former professor.Once the libel was a typical crime of journalists, for which they risked disciplinary fines. But today, thanks to the web, everybody can say everything on blogs, in social network like Facebook or Twitter. And often what we write in internet can reach a widespread audience. That's why "Facebook can not evade the rules of common law and users of social network can not rely on the virtual space as distinguished for their statements and their behavior." Because even if you write on a telematic space, (that seems "non-existent" ) the rights of personality as well as moral goods needs always to be protected.
So now the five teenagers who were thinking only of making a joke to their teacher could be really in trouble, because Article 595 of the Penal Code provides for criminal defamation imprisonment up to one year or a fine up to 1032 euro.

At the beginning the guys had only opened a group on their Italian teacher, but then someone, taking advantage of the internet anonymity, started to write not really nice comments and opinions on the teacher, even something about sex.
The guys didn't know that the teacher was on the same social network. So she found the page and read the insulting comments, from teaching methods to personal assessments. Her students had also inserted a picture, so the page was complete and it's easy to think about the teacher's face when se discover all this.

At this point it is worth to understand: what is the crime of aggravated defamation? The libel in this case is not easy but compounded by means of advertising. Because if we speak bad about someone during a dinner with friends is unlikely that the news will spread. But if you write, black and white on the internet the news, well it can be read all over the world. So the penalties can be up to three years, with possible damages for thousands of euro.
But you should measure not only the words because friends photos, in embarassing attitude, may create a problem, too, unless you had their consent to publication. The joke of a friends can cost really much, and it can integrate civile responsibility.
And if we were to get in front of people a little bit irascible, our pictures could also set a damage to the image that will then be assessed according to the case.
Once only the "stars" would call a lawyer for photos or news of this kind. Now that the libel is also extended to social network, it is worth remembering a simple rule so to not end up in trouble: be more cautious in sharing photos, thoughts and emotions. And remember that our anonymity, on internet, is not so real.

tutto perchè non riusciamo a seguire il bene che sfugge ai più....
Mi pare che ciò sia accaduto ad una professoressa, quando due ragazzi hanno messo i loro dettagli e la sua foto in un profilo che avevano creato loro (sempre su facebook, il social network più conosciuto dell'internet)
ebbene, la professoressa se n'è accorta e ha deciso di denunciarli.
Quindi, è bene che le persone siano consapevoli di quello che fanno, altrimenti possono rischiare veramente una denuncia per diffamazione online.
